1. ELIGIBILITY

You must be:

• at least 18 years of age, and
• competent to enter into legally binding contracts under Indian law.

If you are below 18, you may use the Platform only under the supervision of a parent or legal guardian.

2. ACCOUNT CREATION & USER OBLIGATIONS

(a) Account Registration

To access certain Services, you may be required to create a user account by providing accurate, complete, and updated information.

(b) Account Responsibility

You are responsible for:

• maintaining confidentiality of your account credentials;
• all activities occurring under your account;
• ensuring that your use of the Platform complies with applicable laws.

Dazzl is not liable for unauthorized access resulting from your failure to secure your account.

(c) User Obligations

You agree not to:

1. Use the Platform for unlawful, harmful, fraudulent, or malicious activities;
2. Impersonate another person or entity;
3. Post or upload harmful, defamatory, obscene, or illegal content;
4. Circumvent security features or probe the Platform for vulnerabilities;
5. Use automated tools like bots, scrapers, or crawlers without permission;
6. Interfere with Platform operation or disrupt services.

3. SERVICES & USE OF THE PLATFORM

(a) Nature of Services

Dazzl provides technology-driven services and/or a digital platform to facilitate access to certain products or services as specified on the Platform.

Dazzl reserves the right to:

• modify or discontinue any part of the Platform or Services;
• introduce new features or restrict access to certain features;
• refuse or cancel Services for any reason as permitted by law.

(b) License to Use

Dazzl grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for lawful purposes, subject to compliance with these Terms.

You must not copy, modify, reverse-engineer, exploit, or distribute Platform content without written permission.

4. PAYMENTS, PRICING & BILLING

Where paid Services are involved:

(a) Payment Terms

Payments must be made through authorized payment gateways integrated on the Platform.

(b) Pricing

All prices are displayed inclusive/exclusive of applicable taxes as notified.

Dazzl may revise prices periodically. Continued use after a pricing update indicates acceptance.

(c) Refunds & Cancellations

Refunds, if applicable, will be processed as per the cancellation and refund policies made available on the Platform.

Dazzl reserves the right to refuse illegal, fraudulent, or abusive cancellations.

5. USER CONTENT

(a) Definitions

"User Content" includes any text, images, videos, feedback, reviews, or materials uploaded or shared by you.

(b) Your Responsibility

You represent and warrant that:

• You own or have necessary rights to User Content;
• User Content does not violate applicable law, intellectual property rights, or privacy rights.

(c) License to Dazzl

By uploading User Content, you grant Dazzl a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, store, publish, display, and distribute such content for:

• providing Services,
• improving the Platform, and
• marketing or promotional activities.

You may withdraw certain content rights by deleting content or deleting your account unless retention is required by law.

6. INTELLECTUAL PROPERTY RIGHTS

All intellectual property on the Platform—including trademarks, logos, software code, interface design, databases, text, graphics, audio-visuals, and algorithms—belongs exclusively to Dazzl or its licensors.

You must not:

• copy, reproduce, distribute, or create derivative works;
• use Dazzl trademarks without prior written approval.

Violation may attract civil or criminal consequences.

7. PRIVACY & DATA PROTECTION

Your use of the Platform is governed by our Privacy Policy, which outlines how we collect, store, use, process, and protect your personal data under the Digital Personal Data Protection Act, 2023.

You must review and accept the Privacy Policy before using the Platform.

8. THIRD-PARTY SERVICES

The Platform may include integrations, links, or access to third-party websites, tools, content, or services.

Dazzl is not responsible for:

• third-party accuracy, safety, and availability;
• third-party data practices;
• losses arising from dealings with third parties.

You should review third-party terms and privacy policies separately.

9. PROHIBITED ACTIVITIES

You agree not to:

1. Use the Platform for any harmful, illegal, or fraudulent activity;
2. Engage in unauthorized commercial activity on the Platform;
3. Introduce viruses, malware, or harmful code;
4. Disassemble or reverse-engineer Dazzl systems;
5. Use the Platform in a way that harms Dazzl, its users, or partners.

Violation may result in suspension, termination, or legal consequences.

10. SUSPENSION & TERMINATION

Dazzl may suspend or terminate your access to the Platform:

• for breach of these Terms;
• for violation of law;
• for misuse or unauthorized activities;
• due to technical, operational, or security concerns;
• when required by legal or governmental authorities.

Upon termination:

• your license to use the Platform ceases;
• your data will be treated in accordance with our Privacy Policy.

11. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law:

• The Platform and Services are provided on an "as is" and "as available" basis.
• Dazzl does not guarantee uninterrupted, error-free, or virus-free Services.
• Dazzl disclaims all implied warranties including merchantability, fitness for a particular purpose, and accuracy.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• Dazzl shall not be liable for indirect, incidental, special, punitive, or consequential damages.
• Dazzl's total liability for any claim shall not exceed the amount paid by you (if any) for the specific Service giving rise to the claim.
• Dazzl is not liable for third-party conduct, network failures, data breaches caused by third parties, or user negligence.

13. INDEMNITY

You agree to indemnify, defend, and hold harmless Dazzl, its directors, officers, employees, agents, and partners from any claims, damages, liabilities, losses, or expenses arising from:

• your use or misuse of the Platform;
• your violation of these Terms;
• your violation of any law or third-party rights.

14. GOVERNING LAW & DISPUTE RESOLUTION

(a) Governing Law

These Terms are governed by and interpreted in accordance with the laws of India.

(b) Jurisdiction

Courts in Bengaluru, Karnataka shall have exclusive jurisdiction.

(c) Dispute Resolution

Where possible, disputes will first be resolved amicably through negotiation.

If unresolved within 30 days, disputes may proceed to court as per jurisdiction above.

15. COMMUNICATION & NOTICES

You consent to receive communications from Dazzl through:

• email,
• SMS,
• phone calls,
• push notifications, or
• notices posted on the Platform.

Legal notices may be sent to your registered email address.

16. MODIFICATIONS TO TERMS

Dazzl may modify these Terms at any time. Updates will be posted on the Platform with a "Last Updated" date.

Continued use after modifications constitutes acceptance of updated Terms.

17. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remainder of the Terms shall continue in full force.

18. GRIEVANCE OFFICER

In compliance with the Digital Personal Data Protection Act, 2023, Dazzl has appointed a Grievance Officer.
